1. Agreement and operator
These Terms govern the Ascend website, waitlist, and mobile app operated by Marco Fiel Caparas in the Philippines. By joining the waitlist, creating an account, or using Ascend, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the service.
2. Eligibility and accounts
You must be legally able to agree to these Terms. If applicable law requires consent from a parent or legal guardian, you may use Ascend only with that authorization. You must provide accurate account information, keep credentials confidential, and promptly tell us if you believe your account has been compromised. You are responsible for activity carried out through your account unless applicable law provides otherwise.
3. The service
Ascend is a gamified self-development and productivity tool that turns a user-chosen goal into plans, quests, focus sessions, progress records, and AI-assisted guidance. Features may include deterministic or AI-generated suggestions. AI output may be incomplete or incorrect, and you are responsible for deciding whether and how to act on it.
Ascend is not a medical, psychological, crisis, legal, financial, or other licensed professional service. It is not a substitute for professional advice or emergency assistance. Do not rely on Ascend for diagnosis, treatment, emergency decisions, or decisions where an error could cause serious harm.
4. Founding access through August 31, 2026
The founding launch build provides the included features free of charge through August 31, 2026. Purchases are disabled in that build. Founding access does not create a permanent free tier or promise that every feature will remain available after that date. Before any paid access requirement applies, Ascend will show the applicable offer and terms.
5. Courtesy trial and later subscriptions
For an eligible account that receives founding access, a 14-day, no-card, non-renewing Pro courtesy trial is reserved without starting during the founding period. On or after September 1, 2026, that reserved trial begins automatically at the account's first server-confirmed access check, so trial days do not run while the account is away. The app will show the server-confirmed start and end dates. This courtesy trial does not itself create an Apple App Store or Google Play subscription.
If paid subscriptions are later enabled, the app will show the available product, localized price, billing period, renewal terms, and any applicable trial before purchase. Apple or Google will process payment, and subscriptions can be managed or cancelled through the store account used to purchase. RevenueCat may process store and entitlement metadata to support purchase, restore, and access reconciliation. Store terms and refund rules also apply. Nothing in these Terms limits non-waivable consumer rights.
6. Your content and permission to operate Ascend
You retain your rights in the goals, journal entries, proof media, and other content you submit. You give Ascend a limited, non-exclusive permission to host, copy, process, transmit, and display that content only as reasonably needed to provide, secure, support, and improve the requested service or comply with law. This permission ends when the content is deleted, subject to lawful retention and the practical operation of processor systems and backups.
You must have the right to submit your content. Do not upload content that is unlawful, infringes another person's rights, exposes another person's confidential information without authority, or contains malicious code.
7. Acceptable use
You may not:
- use Ascend to break the law, harm another person, or violate another person's rights;
- attempt unauthorized access, probe security, bypass access or rate limits, or interfere with the service;
- use bots, scraping, or automation that overloads the service or is not expressly allowed;
- manipulate progress, proof, entitlement, or purchase systems; or
- reverse engineer Ascend except to the limited extent applicable law expressly permits.
8. Privacy
The Privacy Policy explains how Ascend handles personal data, including website waitlist data, private app content, AI processing, conditional notification and subscription providers, and account export and deletion.
9. Early-stage service and changes
Ascend is launching as an early-stage service. We may add, change, suspend, or remove features, limits, or integrations. We will provide notice when required by law and will not retroactively charge you without your express purchase action. The service may occasionally be interrupted for maintenance, security, provider failures, or circumstances outside our reasonable control.
10. Suspension and termination
You may stop using Ascend at any time and can request account deletion through Settings. We may restrict or suspend access when reasonably necessary to protect users or the service, investigate suspected abuse, comply with law, or respond to a material breach of these Terms. Where appropriate, we will provide notice and an opportunity to address the issue.
11. Disclaimers
To the extent permitted by law, Ascend is provided “as is” and “as available.” We do not guarantee uninterrupted availability, a particular outcome, continued availability of a feature, or that AI output will be accurate or suitable for your circumstances. These disclaimers do not exclude warranties or remedies that cannot lawfully be excluded.
12. Liability
To the extent permitted by law, Ascend and its operator are not liable for indirect, incidental, special, exemplary, or consequential loss arising from use of the service. Ascend is not liable for harm caused solely by your reliance on AI guidance contrary to the warnings in these Terms. Nothing here limits liability that cannot lawfully be limited, including liability arising from fraud, wilful misconduct, or other non-waivable obligations.
13. Governing law and disputes
These Terms are governed by the laws of the Philippines, without limiting any mandatory consumer protection that applies where you live. Before filing a claim, please contact us so we can try to resolve the issue informally. If it cannot be resolved, a court or tribunal with lawful jurisdiction may decide it.
14. Changes to these Terms
We may update these Terms as Ascend changes. The current version and effective date will be posted here. If a change materially affects existing users, we will provide additional notice where required. Continuing to use Ascend after revised Terms take effect means you accept them, except where applicable law requires a different form of consent.
